Penthouse and below floor water leakage

Water is leaking from the roof of appartment on 5th floor. The builder sold penthouse to other party, and the penthouse is above 5th floor. The open area around the penthouse house belongs to penthouse. Whose responsibility is it to get the water leakage repaired. The penthouse owner or the society. The penthouse owner doesn't pay any maintenance charges to the society.
