03-Dec-2023 (In Civil Law)
Hi Sir, bought a house were common pathway (16 feet) is used by 4 houses within a small community. Promoter lives in one of the house who sold the houses and the road is in name. He claims that only he has the authority on the road and other can only use as a passage. He is restricting everyone not to park the car aside, plant tree etc... Is there any way to make the road common to all(legally to get authority) . Kindly support. Thanks

Yes, on a common pathway no individual can claim title. Rights over the pathway would be conferred in the sale deed. Get me your sale papers for giving proper advice. If any of the right conferred in the sale is violated you are empowered to sue the adverse party.
