Hi, Under the IPC, a doctor can be charged with a criminal offence for medical negligence. Nothing is an offence that is done by accident without any criminal intention and done with proper care and caution. The burden for proving medical negligence lies with the complainant (the patient). The patient must bring forth clear evidence of medical negligence. If you have all the evidence, then please consult an advocate to file a suit in appropriate tribunal/forum.
