Open drainage constructed by neighbour in the street

I am living in a corner property and my neighbour has constructed a open drainage in the road which is nearby my house and it causes disturbance for bike and car to pass through and also the water overflows and comes to the street. We don't have patta for the anyone in our street, can we file complaint? Please help me with the process

Holding patta is not essential to file a complaint, possession alone is sufficient to question the nuisance. Write a complaint to the local body. Number of Complainants matters in public nuisance. Also you can file an application under Section 268 of IPC in the court of magistrate. For further querry you can contact me over phone.
