You will first have to apply before the office of the Municipal Corporation / Gram Panchayat concerned (place of birth) for issuance of a Non-Availability of Birth Certificate (NABC). The authority conducts a record search in the birth register for the relevant year. If no entry is found, they issue a written certificate stating that the birth record is not available. Once the NABC is issued, depending on your purpose (passport, visa, correction of records, late registration etc.), further legal procedure may be required such as filing an affidavit, submitting supporting documents (school records, hospital records, Aadhaar, etc.), and in certain cases approaching the Magistrate Court for delayed registration under the Registration of Births and Deaths Act. The timeline usually ranges from 2–4 weeks for the NABC from the local authority. However, if court intervention is required, it may take 1–3 months depending on jurisdiction. Since documentation and procedural compliance are very crucial in such matters, this process should ideally be handled through an Advocate to ensure proper representation and avoid rejection or delays
