Nephew of owner refusing to vacate flat

27-May-2025 (In Civil Law)
I am a committee member of a society, and there is a nephew of the owner, who is creating nuisance, fighting with others. His behavior has been communicated to his owner, his aunt, and she has formally given us a letter to kick him out of the society. He had been staying here for 15 years. Now, can we ask him to vacate on the spot?

Since the flat is owned by the uncle and the aunt of the person residing in the flat. Hence only uncle and aunt that is the owners of the flat has the authority and to file a suit for getting the flat vated by their nephew. society is only concerned with the maintenance and other responsibilities. society does not have any local standi to fike suit and get the said flat vacted. society can ask the owner to file a suit and get the flat we get it vacated. However if the concerned person is harassing other members they can file a separate criminal complaint against the person residing in the said flat. Regards
