I am the Respondent of the Appeal Suit, now the case was DISPOSED and the Nature of Disposal is UNCONTESTED--DISMISSED. Clear me what is mean by CASE DISPOSED & UNCONTESTED--DISMISSED. Pls Explain.. 1. Is the Appellant can Re-open the case. If Yes, within how many days he has to Re-Open..?. 2. As a Respondent, is it possible to object to Re-open the case.

Appellant can reopen the case when he/she give proper cause to show his inability to conduct the case. They can file section 5 petition stating proper reason. Now you can do one thing, issue a legal notice to appellant regarding dismissal of the suit same stating you are ready to contesting the case. It is useful to contesting when appellant file condonation of delay petition. When you give the notice to appellant you have many chances to succeed in condone delay petition.
