Under the RTI Act, “information” refers to records that the public authority maintains and is obliged to provide. Certain records, such as internal election votes or ballot papers in religious or private trust elections, may not qualify as “information” for disclosure because they are considered internal, confidential, or not public documents. The rejection stating that the information cannot be regarded as “information” under Section 2(f) is legally permissible. For appeal, you can file a second appeal to the Central/State Information Commission, clearly stating that you have already submitted the first appeal and providing your grounds for why the information should be public, such as transparency in trust elections. Attach copies of all previous correspondence for reference.
