Legal action against absconding employee

Our company is registered under companies Act. Company policies say that you should server notice of 2 months before leaving. One of our employee has absconded he has company property like company laptop, company seal and cash worth Rs.25,000 in his possession. We have sent enough warnings. He once replied he will return it after F&F settlement. We asked to return our property first. A Legal notice is also issued to him, but no response. What should be the next step now? Which court do we approach? Is filling a case advisable? Or would it be another added expense?

Hi, on the basis of your query as I understand that a legal notice has already been served upon him. And as there has been no revert from the absconding employee, you may file a Criminal Complaint of Misappropriation or Criminal Breach of Trust. Let the police start for search and recover the Company Assets which are in his possession.. In case of non action by police file a petition in the jurisdictional court on the above offences through an Advocate. Let me know if you need any assistance from my end at free of cost.

It is suggested that you file a police complaint against the said employee for theft of company products and ask the police to take action. This will be the quickest and easiest remedy to get back the company property. Litigation would be a very long protracted wait.
