Land issue about adverse possession of land

13-Dec-2023 (In Civil Law)
We bought a land in 1978.It was a road side plot and when we bought it, it was a farm.Since the land was farmland, there was a small drain between the road and the land through which water could reach the remaining fields. But now a building has been built on our land and there are no fields nearby. Now he is showing the drain in the name of our land owner's grandson and he is blackmailing because of this.

You can file a civil suit for declaration and perpetual injunction in the civil court. While you have purchased the said plot, a sketch mal would have been provided to you during the registration. By using that sketch map you can file a civil suit in the civil court. Once the court holds that the original position of the drain is not in your land then no one can oust you from there. Further file an injunction as well so that no one disturbs the peaceful possession.
