Land acquisition by Semi Government Authority

05-Jun-2023 (In Civil Law)
I’m resident of Yavatmal Dist.,Maharashtra. In 1985, I didn’t have any agricultural land. For purchase of 5 acre land, I applied to Sub-Divisional Officer of Yavatmal. The officer granted me the permission to buy the land u/s 89 read with rule 45(9) of B.T and A.I. Act 1958 for non-agricultural purpose i.e. for residential purpose. As per the permission to treat the land as non-agricultural land, I did not use the land to cultivate any crop. The land had drinking water well and electricity D.P. In 1995, the land was acquired by Maharashtra State Industrial Development Corporation (M.I.D.C.) authority of Yavatmal and compensated me as per the rates prevailing for per hector of agricultural land. The compensation judgement is passed by Yavatmal Court and Bombay High Court – Nagpur Bench. I would like to know, what is the status of land – agricultural land or non-agricultural? If it is treated as non-agricultural land is there any supporting law for the same? Please share the references.
