The decision to take bail is a proactive step to secure or maintain personal liberty. Since 498A is a non-bailable offense, formal bail (either anticipatory or regular) is required to avoid or undo arrest, irrespective of the perceived severity of the allegations

It’s depend upon severity of allegation. Due to frequent misuse, the Supreme Court has directed police to verify complaints and set up Family Welfare Committees (FWC) to test veracity, making arrests less automatic. But you will have to take a regular bail.

Short answer: Yes, it is advisable to take bail in a case under Section 498A, even if the allegations are not serious. Explanation in simple terms: Section 498A IPC is a cognizable and non-bailable offence. This means the police can register an FIR, but immediate arrest is not mandatory in every case. If the allegations are not serious: If: There is no physical violence or serious injury There is no strong medical or independent evidence The dispute appears to be matrimonial or domestic in nature Then, as per the Supreme Court judgment in Arnesh Kumar vs State of Bihar: Police should not make automatic arrests Police must first issue a notice under Section 41A CrPC instead of arrest Is bail still necessary? Once an FIR under Section 498A is registered, applying for Anticipatory Bail is strongly recommended It protects the accused from sudden arrest and unnecessary harassment Can one manage without bail? Legally, it may be possible Practically, it is risky, because: Police discretion can change Arrest can happen at any stage during investigation Conclusion: ✔ Even when allegations are mild, ✔ Taking Anticipatory Bail in a 498A case is the safest legal option
