Inheritance of grandmother’s property
18-Dec-2023 (In Civil Law)
Can my mother write a will giving the house inherited from my grandmother to my sister ? She has been completely manipulated by my sister and her husband
anyone can gift a property in one's name. if the property has been inherited by your mother and the same has her name in the title records of the land then your mother can gift the property to anyone, provided the same is done without any undue influence, coercion, etc. and out of her own free will.
Hi. Yes, your mother can do so. However, such a Will can be contested on grounds of undue influence and coercion. It is difficult in law to contest since the burden of proof will be on you to prove the same. So you will have to collect evidence which will demonstrate the fact that your mother has been influenced.
