I'm the owner of ground and first floor of a four storey building measuring 300 sq yards in delhi (old construction)nWe have 50% uds on plot of land with the second and third floor ownersnThe second and the third floor owners have 50% unspecified undivided share on plot of land with roof rightsnnThey claim that they have 50% right on The open space around the building including (the front and rear setback ) and they want to park their vehicles on the front setback and use it as driveway and need seperate way to access rear setback on ground floor as they have 50% uds on plot nnThe common area as per partition deed documents include only common entrance, passage and stairs between the ground first and second third floor ownersnnCan they legally claim the front and rear setbacks on the ground floor?

1. no they cannot be really claim the front and rear set backs on the ground floor. 2. the partition deed shall be applicable with States the common area passage and stairs 3. undivided share in a plot is applicable when there is no building and only a vacant piece of land exists. 4. therefore the second and third floor owners cannot claim any rights on the ground floor based on their undivided share in the plot should you have for the queries feel free to contact me
