Sir mere pass ek shop hai jo ek temple ki permisses ke andar hai vo puri jameen Delhi Government Authority ki hai aur hum vha last 40 year se kabje me hai to humare adhikar kya hai aur kanoon hume kya protection deta hai last abhi ek case me Delhi Devlopment Authority ne use old Encroachment maana hai
Yes as per the law you are in adverse possession. Adverse possession is when you have been residing and occupying a property for 12 years in case of private property and 30 years in case of government property. After expiry of the above mentioned period, there cannot be any cause of action and the adverse possessor i.e. you will acquires the right, title and interest of the original owner(s) of the property. You will becomes entitled to deal with the said property in the way you like or desires.

Agar aapki shop ko old encroachment mana hai par agar apka 40 saal se kabza hai property pe toh aap adverse possession claim kar sakte hai court se. Jisme aapko court se ye decree mil jayegi ki aapka kabza hai property pe jo ki uninterrupted tha.. aap apne naam mutate kara sakte hai dukan phir.
