illegal sewage outlet pipe constructed by my neighbor

22-Jun-2026 (In Civil Law)
my neighbor installed sewage outlet pipe above ground level on the street outside the wall directly faces my main entrance, making the situation more hazardous and unlawful. I have requested to remove the pipe verbally but they said they are not using it. Now they are going to sell the house. Is it allowed sewage pipe to install above ground level outside the plot? What can I do?

Submit a written complaint to the concerned municipal authority. Since you are in Kolkata, if the property falls within the jurisdiction of the Kolkata Municipal Corporation, the complaint may be addressed to: Executive Engineer (Building Department); Borough Executive Officer; Health Department. Request inspection and removal of the unauthorized drainage outlet. You may approach the Executive Magistrate under Section 133 of the Code of Criminal Procedure, 1973 (corresponding provisions under the Bharatiya Nagarik Suraksha Sanhita, 2023) seeking removal of a public nuisance. The Magistrate can direct removal or alteration of the offending structure. If the nuisance interferes with your enjoyment of your property, you may file a suit seeking: Permanent injunction; Mandatory injunction directing removal of the pipe; Interim injunction restraining further use.

If the sewage outlet pipe has been installed outside the neighbour’s property boundary and projects onto a public street, common area, or municipal land, its legality will depend upon the applicable municipal by-laws, sanctioned building plan, and local drainage regulations. A property owner generally cannot create a nuisance, obstruction, or health hazard affecting neighbouring properties or public areas. Since the pipe is located directly opposite your main entrance and you apprehend inconvenience, hazard, or unhygienic conditions, you should document the situation with photographs and submit a written complaint to the concerned Municipal Corporation, Municipality, Panchayat, or local authority requesting an inspection. The authority can verify whether the installation conforms to the approved plan and applicable regulations. If the structure is found to be unauthorized or causes actionable nuisance, the authorities may direct its removal or modification. In the event no action is taken, you may also consider appropriate civil proceedings seeking injunction and removal of the nuisance. The fact that the neighbour is proposing to sell the property does not legalize an unauthorized installation, nor does it extinguish your right to raise objections regarding any continuing nuisance or encroachment. The exact remedy, however, would depend on the location of the pipe, ownership of the land where it is installed, and the applicable local laws.
