I am married to girl who is a constable in Delhi police. On a small argument she filled false complaint against me and my brother. IO said charges are serious and your brother can be arrested.they are regularly calling us in the police station me and mother visited but their behaviour was very rude and one sided as she has very strong links in PS. Now they are calling my brother and I am sure they will arrest and intimidate or torture him in the cell. Our lawyer suggest do not go to police station at all without any notice. My question is what is legal shall we go to PS or shall we not. What if we don't go to PS what action they can take
hello sir, I would like to know if there was any kind of investigation carried on after the said complaint was been lodged? was there any kind of proof been collected that would gradually result in arrest of your brother?. becoz the police cannot arrest anyone without reason and without the permission of the magistrate. and if the police finds any reason that is appropriate for the arrest there your brother can apply for an anticipatory bail.

Firstly move an application for anticipatory bail before the Court of Sessions of concerned PS. Once the order will be passed by the Sessions Court then it will be quiet easier for you to tackle the officers of PS
If the officials from PS call you to come to PS then ask him to serve a notice.
