I am living in my Brother's for over 32 years. I am a Senior Citizen.
06-May-2025 (In Civil Law)
I am living with my family in my brother's house for the last 32 years, but not as a tenant. My brother is alone since his wife died and he has no issue. I am a senior citizen over 70 years of age. My wife is also a senior citizen. We have a married daughter. Can my brother evict my family from his house?
hello, Even though you have been living in your brother’s house for 32 years, since there is no tenancy or ownership established, your right to stay depends on his consent. As the legal owner, your brother can ask you to vacate unless you can prove that you have contributed to the property’s construction or upkeep or that there was a family arrangement or implied consent over the years that grants you some equitable right. However, since you are a senior citizen and have no other place to stay, you may seek relief under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. The court may consider your age, relationship, and duration of stay before passing any eviction order. You should try to resolve this amicably or seek legal advice for filing a civil suit for residence rights if needed.

Legally, your brother has the right to evict you, but he must follow proper legal channels, and you may get temporary protection from the court based on your age and long-term residence. However, you do not have ownership or tenancy rights, so a permanent claim on the house is unlikely unless there's a will or gift deed in your favor.
