How to Vacant temporary injuction on plot of land

11-Aug-2024 (In Civil Law)
I want to sell my property which is my name and possession since more then 40 years . My neighbour has brought temporary injuction against its sell and has filed title suit also on the ground that his land is being encroached by me. No notice was issued to me before granting injunction. The clear moto is to grab money from me. Don't the provisions of law of limitations apply in this case? How should I proceed in trial court from getting injuction waved? If waived, can I dispose off my prpendency

it's highly improbable to grant injunction without serving a notice Unless the court prima facie find facts of encroachment from your end. u may proceed to vacate the order but the TS will remain untill a conclusion is drawn by court. u may have to defend your side to establish that the plaintiff has filed a false case. untill then it will be difficult to actuate the sale.
