A person residing in Maharashtra but born in Uttar Pradesh (UP) does not need to return to their native place to create a gazette notification for a name change. Gazette publication is based on the place of current residence, not birthplace. Therefore, the individual can apply for name change publication through the Maharashtra Government Gazette office. This process typically involves preparing an affidavit, publishing the change in two newspapers (one local and one national), and submitting the required documents (affidavit, ID proof, address proof, newspaper clippings, and photographs) to the Gazette Department. If the person still chooses to apply through the UP Gazette, the procedure will be similar: (1) Create a notarized affidavit declaring the name change, (2) Publish the name change in two newspapers, (3) Submit documents to the Department of Publication in Lucknow or relevant office. The process may take about 30 to 60 days, depending on the department's timeline. Physical presence may be required only if in-person verification is asked for, but often, the submission can be done through post or an authorized representative. In summary, using the state of current residence is faster and more convenient, and returning to the birthplace is not mandatory for gazette publication.
