Gated house with one wall left unbuilt, pedestrians passing through

01-Jan-2025 (In Civil Law)
Is it wrong to look after the safety of my mother who is senior citizen and alone, after the demise of my mother? She stays in a house with gated property but one wall is unbuilt as her neighbours who are her brother's sons ,will not allow it to built. They want to use her property to commute ,inspite of having a different road to their property. She is threatened multiple times, when she attempts to build it. Can She get protection from law to build the wall? Should she file FIR?

You must file a civil suit against the neighbour for an injunction against him from trespassing your property or causing any other inconvinience. With the injunction order, you can complete a wall in the boundary. If they make any issue, it is against court order and police protection can be sought for.

The documents and the field visit is recommended. Civil and criminal remedies may available. More details of the incident is necessary. Matter related to senior citizens gets special attention in legal system
