Foul smell from neighbor's poultry business in residential area

25-May-2025 (In Civil Law)
I live in a rural panchayat area. A person next to my house is running a poultry business. The foul smell from the chickens and waste is unbearable and affects my health and daily life. My house is the only one in this area ,so we are severely affected. Is this legal in a residential area? Can i complain to the Panchayat or BDO? What legal action can i take under public nuisance or health laws?

Yes definitely you can take legal action against the concerned poultry farm owner for polluting the residential environment. You can take both criminal action as well as civil action against the owner. Usually these types of farms should not be opened in residential places keeping in concern the health and safety of the population living there. First of all register an FIR against the concerned poultry farm owner. Remember, the drafting of the FIR is very important, so there should be a careful drafting of the FIR so as to book him under criminal laws or else he would escape from legal action and punishment.

You can first send a legal notice to him asking him to manage his waste better and state that it is affecting your right to life and also such construction is not allowed in a residential area and he does not stops after that you can file a civil suit against him to pay compensation and remove his farm else where
