For correction of DOB in High School marksheet/certificate, you should not directly file writ. You need to exhaust alternative remedy first. Procedure for correction: 1. Check Board Bye-laws: For CBSE, as per Bye-law 69.1, application for correction in DOB must be made within 5 years from declaration of result. For UP Board and other State Boards, similar limitation is there. If there is delay, you have to explain delay in writ. 2. Representation to School & Board: First file a written representation to your School Principal and to Secretary/Regional Officer of concerned Board along with Original Birth Certificate issued by Municipal Corporation, Aadhaar Card, School Admission Register copy and an affidavit. 3. Cause of Action for Writ: If Board rejects your application or does not reply within 30-45 days, that rejection/non-action will be your cause of action to file Writ Petition under Article 226 of Constitution before Hon'ble High Court for Mandamus to direct Board to correct DOB. 4. Documents required for Writ: Birth Certificate is the most important and conclusive proof, along with other ID proofs and application copies. Limitation is important. If delay is very long and for service benefit, Court may not allow. If genuine mistake and supported by birth certificate, High Court may allow. Please provide your Board name, Year of passing and difference in dates for precise advice.

Yes you can file writ petition for correction of DOB in High School marksheet and when you file the writ, court will most likely direct you to file representation before the concerned authority who will then decide your representation

Before filing a writ petition in the High Court, you must exhaust all statutory remedies available under the law. A writ petition under Article 226 of the Constitution is generally entertained only when there is a violation of fundamental rights or a failure of statutory authorities to act. Therefore, your first step is to apply to the concerned Central Board of Secondary Education (CBSE) or State Board, along with your school, requesting the correction of your Date of Birth (DOB). You must submit supporting documents, such as your Birth Certificate issued by the Municipal Corporation, Aadhaar card, and passport, to prove the correct date. If the Board rejects your application or fails to respond within a reasonable period, only then can you approach the High Court. When drafting the writ petition, you must implead the School, the Education Board, and the State Government as respondents. The petition should clearly explain the genuine clerical error, the supporting documentary evidence, and the unreasonable delay or arbitrary rejection by the authorities. You must also mention that you have exhausted all alternative remedies. The High Court can issue a Writ of Mandamus directing the Board to rectify its records. However, courts are generally reluctant to entertain such pleas if filed after a long delay, as DOB corrections affect academic and service records. Therefore, act promptly, gather strong documentary proof, and consult a local advocate specializing in service or education law to draft and file the petition properly.
