You're facing a noise pollution issue due to the vehicle washing service station next to your home. Here are some steps you can take to address this: *Legal Provisions* - The Noise Pollution (Control and Regulation) Rules, 1999, govern noise levels in India. Although these rules might not directly mention vehicle washing service stations, they do cover noise pollution from industrial and commercial activities ¹. *Steps to Address the Issue* - *Document the Noise Disturbance*: Keep a record of the noise levels, dates, and times when the disturbance occurs. You can use a noise level meter app or consult with a noise expert. - *Talk to the Service Station Owner*: You've already done this, but it's essential to keep a record of your conversations and any agreements or refusals. - *Contact Local Authorities*: Reach out to your local pollution control board or municipal corporation and file a complaint. They can inspect the service station and take action if noise levels exceed permissible limits. - *Seek Mediation*: Consider mediation through a local community association or a neutral third party to resolve the issue amicably. - *Approach the Court*: If other measures fail, you can file a complaint under the Environment Protection Act, 1986, or the Noise Pollution Rules. Consult with a lawyer specializing in environmental law for guidance. *Additional Tips* - *Noise Reduction Measures*: Suggest that the service station owner implement noise reduction measures, such as: - *Soundproofing*: Installing sound-absorbing materials or acoustic panels. - *Machine Maintenance*: Regularly maintaining machines to minimize noise. - *Scheduling*: Operating noisy machines during less busy hours. - *Neighborhood Support*: Gather support from nearby residents who may also be affected by the noise pollution ². Remember to prioritize your health and well-being while pursuing a resolution.

You can file civil suit for injunction against these people who are causing nusance to you, you can maintain an application for ex parte interim order application also so that you will be able to stop that nusance may be in the first week of civil suit that will give you temporary relief once the case is finally decided you will have a verdict wherein that machine will be removed completely.

Dear Sir, If your neighbor is causing a nuisance such as excessive noise, pollution, encroachment, or any other unlawful activity that disrupts your peaceful enjoyment of your property, you can file a civil suit for injunction under Section 38 of the Specific Relief Act, 1963 to legally restrain them. Courts often grant interim injunctions at the preliminary stage itself if you can establish three key elements: (1 a strong prima facie case demonstrating that the nuisance is unlawful and affecting your rights, (2) the balance of convenience** in your favor, meaning the harm you face outweighs any inconvenience to the neighbor, and (3) the possibility of **irreparable harm** if the nuisance is not stopped immediately. To strengthen your case, gather **evidence** such as photos, videos, witness statements, and copies of any prior complaints made to the police or local authorities. It is also advisable to first send a **legal notice** to the neighbor, as this can sometimes resolve the issue without litigation. If the nuisance persists, your lawyer can file a suit in the appropriate civil court, citing relevant laws such as Noise Pollution Rules. Courts have a history of granting interim relief in such cases, ensuring swift protection of your rights. For the best outcome, consult a lawyer to tailor the legal strategy to your specific situation.
