Encrochment Issue and rented Premises blocking private drainage lines

19-Nov-2025 (In Civil Law)
purchased a house that has an encroachment issue. The neighbour has blocked the 2-feet common drainage pathway that he had earlier sold to the previous owner, and they are also occupying 1-foot of our land (around 31.75 sq ft), totalling nearly 100 sq ft illegally used for a commercial car accessories shop. They agreed to remove still raised stop injunction order in civil court. What can be done to speed up. Fir lodged against 3 man on harassment of me under 296 b, 324(4), 351(2). No response

Dear Client, 1. The neighbour’s obstruction of the 2-feet common drainage pathway and encroachment of nearly 100 sq. ft. of your land amounts to an illegal trespass and violation of your property rights. Since they continue to occupy the area despite agreeing to remove the encroachment, your remedy is to pursue the pending civil suit and seek an interim mandatory injunction for immediate clearance of the encroachment and restoration of the drainage pathway. You may also file an application for early hearing/expedited disposal citing ongoing hardship. Parallelly, the FIR for harassment must be followed up with the police or through a petition before the Magistrate to compel action. 2. Consult an advocate to discuss your case in brief. 3. You may schedule an appointment regarding your case by phone or email at your convenience. Thanks & regards, Priyanka Advocate Coimbatore

You can defend your case in the civil suit filed against you and also you can file suit for recovery of possession and injunction against themselves. if FIR is registered against them you can follow up with the investigating officer. feel free to contact for any legal advice.
