Educational Trust's Trustee can employ his relative what to do

A trustee of an educational trust can employ his relative in the trust run school or not. The local charity inspector is denying the recruitment saying as per Bombay Public Trust Act 1950 a trustee can not be a beneficiary in the trust. Please guide what reply to give to Charity Inspector.

there are two laws applicable. one is Bombay public trust act and second is educational institution act. DO office has grant the permission to run the school on the basis of trust registered under the Act. Now your question is for giving the employment then the relatives of the trusty can be qualified for the said post then he can employ in the school. The Charity inspector has no any power to interfere in the school. DO Office has power.

it depends upon the qualification of the candidate not the relation

if the school is governed and granted by any of the state government then you must provide fare opportunity to general public to avoid any litigation

You are right that trustee can not be beneficiary from trust but trustee can employee any person in his trust except him.
Give a simple reply that we have not violated any provisions of Bombay public trust.
If he is not agreed that you can file appeal against his decision in charity commissioner.
