Easement right of way issue by neighbour

27-May-2024 (In Civil Law)
Hello, My dad purchased house which had no road. My father obtained easement right of way from neighbour through stamp paper agreement. Now the owner has changed and he is obstructing our way to house. The old owner of the house used the same road to reach main road. What can be done by me since my father expired last year and then the neighbours have started to trouble us. By not letting us use the 5feet way of easement.

Ann easement is a legal right that allows someone else to use a portion of your property for a specific reason. The important thing to know is that easement carries over when a new owner assumes the property. In above situation you can seek an injunction from the Court, which is in order requiring the new owner to either take specific action or to stop a particular activity that interferes with your easement.
