Do i have to mention criminal record while applying for new passport

Dear Sir, I would like apply for fresh-passport, in that following question is there Have you ever been charged with criminal proceedings or any arrest warrant/ summon pending before a court in India? But in my name one case was filed in the year of 2008. that case also closed in 2009 . in that case i didn't punished by court. so for above question weather i need to mark as Yes or No. Plz.suggest me.

Unresolved criminal cases.
If there are any unresolved, or pending criminal cases against you, neither the passport office nor the police station can take any steps towards approving your passport until the case has been resolved in court, or, a court order for a temporary short-term passport has been obtained.
If your criminal cases have been resolved but you have still received an “adverse” PV report, you can take a copy of the court order to the RPO and request a re-verification.
In any case, if the issuance of the passport has been delayed, merely contacting the RPO with the relevant file number will give you access to the information about why it was delayed, or why the process has been held up. Once you know the problem, you can contact the relevant authority to have your passport issued faster.
