Delay in getting pf and gratuity settlement
10-Jun-2026 (In Civil Law)
My Father is law expired 2.5 years ago and he was a govt primary school teacher employed in Serampore girls high school Hoogly district. After his demise, my Mother in law and wife have submitted all the required documents in Hoogly SI office but till now they haven't got any reply regarding the pf and gratuity settlement. Even they haven't got any confirmation regarding the family pension.
What legal step should we take?
Dear Client,
Both PF and Gratuity are retirement benefits payable to an employee post retirement from service under the Employees PF &MP Act, 1952 and the Payment of Gratuity Act and both are payable within 30 days of retirement from the date of submission of application While Gratuity is payable by the State Government, PF is payable by the PF authority on receipt of certified application of an ex-employee from the concerned employer. So, in the given scenario of inordinate delay in processing the application for PF and Gratuity, you can submit a complaint to the State Education Department, the Labour Commissioner and the Regional PF Commissioner concerned seeking appropriate relief failing which consult with an expert professional dealing social security laws for tailored advice and steps to navigate the matter legally and effectively.
