Clarification on OBC NCL Eligibility for Child of Group D Employee

16-Jul-2025 (In Civil Law)
My father is a retired Army Lance Naik (Other Ranks) and currently works as a Group D employee in MES (Central Govt). Our caste (Saini, Haryana) is in the Central OBC list. His annual salary exceeds ₹8 lakh. I seek clarity: Is salary considered for OBC Non-Creamy Layer if the parent is in Group D? Many sources claim Group C/D children are always NCL, regardless of income. Please confirm with reference to any official rule or circular.

Yes, you are eligible for OBC Non-Creamy Layer (NCL) status. As per DoPT resolution and NCBC guidelines, income is not considered for NCL eligibility if the parent is in Group C or D, whether serving or retired. Since your father is a retired Army Lance Naik (Group C) and currently employed in Group D in MES (Central Govt), you fall under non-creamy layer regardless of his salary exceeding ₹8 lakh. The creamy layer test does not apply to children of Group C/D employees. Hence, you can validly claim OBC-NCL status.

Hello sir/mam as per Your Query Since your father is a Group D employee and not in Group B or A, and unless he was promoted to Group B before age 40, you are eligible for OBC Non-Creamy Layer benefits under central rules , regardless of his income. Thank You Regards Advocate Kuber Hooda

Yes, you are eligible for OBC Non-Creamy Layer (NCL) certificate regardless of your father's income, because your father is employed in a Group D (Class IV) post in Central Government (MES), and he was earlier a Lance Naik (Other Rank) in the Army.
