Can the college stop my tc or degree for not joining a company?

10-Oct-2025 (In Civil Law)
Hey, so I have an offer from a company which recruited on campus. I have signed the offer letter. But for last 2 months they have been postponing the onboaring. Now I have decided to go for higher education. But the issue is my college placement policy says retention after signing offer letter is only applicable for unavoidable circumstances. So if I withdraw my acceptance from company can they stop my tc? Or stop me from getting my final degree? I already have my provisional degree certificate.

Completed your course, Cleared your dues, and Fulfilled all academic requirements, your college has no legal right to hold your: Transfer Certificate (TC) Degree / Provisional Certificate Mark sheets or other original documents Even if you backed out of a placement offer, the college cannot use your certificates as pressure or punishment. 2. What the law regulations say

Well, no one can stop you from getting a final Degree irrespective of the fact that whether you withdraw your acceptance or not. If the concerned Institution is withholding your Degree then it is extortion.

Most campus offer letters are conditional — employment starts only after onboarding and joining. Since onboarding never happened, there’s no employer-employee relationship yet. Hence, your client can legally withdraw before joining. 2. College Placement Policy vs. Legal Rights The college’s “retention policy” is an internal disciplinary guideline, not a legal restriction. They can, at most, restrict placement cell privileges (like future campus opportunities), but they cannot legally withhold the Transfer Certificate (TC) or final degree. Once the provisional degree is issued, the university is obligated to issue the final degree after due time — it cannot be withheld for a placement-related reason. 3. What the College Can’t Do They cannot stop your final degree or withhold your TC merely because you withdrew from an offer. These are academic documents governed by the University/UGC regulations — not by the placement office. 4. What the Client Should Do Send a polite withdrawal email to the company stating that due to higher education plans, they wish to withdraw from the offer. Also inform the placement office in writing, mentioning the delay in onboarding and enclosing the withdrawal email.
