it is not a crime till the reasons are bonafide, you can opt for improvement as well in same board to increase the percentage but it is not a crime in india to pass 12th two times from two different boards in consecutive years.

There are few guide lines issued by the CBSE board and as per CBSE rule, one can pass 12th two times from different boards. I would like to clear herein that you have to go according to CBSE rule of Improvement of performance in class 12th.
Now I am going to explain of your question as following:
1. a candidate who has passed an examination of the Board may reappear for improvement of performance in one or more subjects in the succeeding year only.
2. a candidate who has passed an examination of the Board under Vocational Scheme may reappear for improvement of performance in the main examination in the succeeding year or the following year provided they have not pursued higher studies and may appear as private candidates.
3. Those reappearing for the whole examination may, appear as regular candidates a if admitted by the school as regular students.
4.The candidate appearing for improvement of performance can appear in the subject only in which they have appeared for the Examination.
5. For practical subject, in case the candidate has passed in practical at the main examination, shall be allowed to appear in theory part only and marks in practical obtained at the main examination shall be carried forward.
6. In case a candidate has failed in practical, shall have to appear in theory and practical both.
7. Candidates who appear for Improvement of Performance will be issued only Statement of Marks reflecting the marks of the improvement examination.
8.A candidate appearing for Improvement of Performance in one or more subjects cannot appear for additional subject simultaneously

no not at all. there are cases where students change their stream if they can not cope up with the other stream. But then you can not take admission in college on the basis of prior chosen stream.
But it would not be considered as crime.
