Can I file a Jansunwai complaint without evidence for fake RTE admission in ghaziabad UP, I know they live in a good rented flat, run all cash business, faked income certificate by getting fake salary certificate from his friend's business & re-admitted child in nursery via RTE after good private school education for 1 year, On top of this their younger child is studying in a private school ? Their child is studying from last 2 years under this scheme. Wasting a poor child seat.

You need not worry about liability if you only helped fill the form online in good faith without knowing the family had produced a fake certificate. Criminal liability requires mens rea (guilty intention). Since you were not part of the forgery or beneficiary of the fraud, you cannot be held responsible. If you want to file a complaint, Jansunwai (UP Govt. portal) is an appropriate step. While doing so, clearly state that your role was limited to technical assistance and that you were unaware of any misrepresentation at the time. Attach any supporting information you have (e.g., proof of their income, second child in private school, etc.) so authorities can investigate. At most, you may be asked to provide a statement during enquiry, but legal action against you is unlikely unless there is evidence that you knowingly assisted in producing fake documents.

yes you can file jansunwai complaint without evidence for fair enquiry of the admission gaziabad up ,if you have no any proper evidence and the you have right to file your complaint and govt give response to your complaint
