Can i apply for visa if a criminal case is pending

I met with an accident and filed FIR on my name to claim insurance for 3rd party. As a driver my case is still not came for hearing under Section 304 A. Can i able to apply for US visa? After case closed also, is that will be offence to apply VISA? Please confirm.

Just compromise the case and get it quashed in view of compromise but such option if not entertained by High Court then please see that required material witnesses are brought on a single day or two and get them all of them turn hostile.
