Building Deviation From Approved plan in chennai neighbor sued us

Hi We have built our building in our own land with 1 floor on the top in Pallavaram, Chennai Tamilnadu. We have got plan for 795 sq ft, but we have built it up for 850 sq ft both in the ground as well as in the first floor. Our Neighbour had now sued a case against us in Chennai High Court that we have not built it up according to the plan. Would the case end up in demolishing our home or is there any penalty that we could pay and get off from this? Please do reply sir/madam, we all are totally worried on this issue. :( :( :(

It depends on whether you have paid the property tax and the regularization fees, whether have you occupied the house, etc. Anyhow, it will not go to such an extent of demolishing the structure unless situation is very grave.

Sir/Madam,

Do not worry. Building deviation are common and demolition is not the only remedy to rectify such deviation and court knows that. There are other ways to come out the problem. The court will not tell you to demolish at the first instance. You will be having time before they take another step. The CMDA/DTCP (planning authority) which has given the planning permit will be one of the necessary party to this suit. There reply plays a important role in your suit. Discuss it with a lawyer.
