If both individuals are adults and the relationship is consensual, there is no criminal offence merely on the ground of live-in relationship, even if the man is married. The Hon’ble Supreme Court has repeatedly recognised live-in relationships between consenting adults as falling within the ambit of the right to life and personal liberty under Article 21 of the Constitution of India. However, certain legal consequences may arise due to the subsisting marriage of the man. While adultery is no longer a criminal offence, it remains a ground for divorce under personal laws. The wife of the married man may initiate matrimonial proceedings, including divorce or maintenance. If the girl’s family takes action, they cannot initiate criminal proceedings solely on the basis of a consensual relationship. However, allegations such as coercion, cheating (e.g., false promise of marriage), or abetment may be raised depending on facts, which can create legal complications. Regarding the man being in police service, departmental rules are stricter. Such conduct may be treated as misconduct, especially if it brings disrepute to the service, and can lead to departmental inquiry or disciplinary action. Thus, while no direct criminal liability arises per se, civil, matrimonial, and service-related consequences are possible.

Hi....Live in itself is not illegal. Main risk is from wife matrimonial cases and false criminal allegations by girl’s family. Job impact depends on nature of service, especially strict in government service.

A relationship between two consenting adults is not illegal, even if the man is married. However, there are some legal points to keep in mind: • Adultery is no longer a criminal offence, but it remains a valid ground for divorce. The wife can file for divorce and claim maintenance or other reliefs. • Live-in relationships between consenting adults are legally recognized, provided they are voluntary. • Action by the girl’s family: If the woman is an adult and acting out of her own free will, her family cannot take legal action just for disapproval. However, in some cases, complaints like kidnapping or coercion may be filed, which can create temporary legal issues.
