About covered balcony and modifications in balcony in CIDCO Panvel

14-Jan-2023 (In Civil Law)
I have purchased a reselling flat in panvel CIDCO, on 1st floor. I have balcony area of around 400 sqft. My balcony was already covered. The other neighbours besides me also covered balcony after OC. Now the story is as below; I want to break the non load bearing balcony window wall to get the view (want to increase the window height) When I ask for the permission of society they denied by giving the reason of aesthetic. I visit the building development authy in CIDCO, they said there is no problem to do that but we can't give in writting. Go to private architecture and take the certificate from him and show it to society. But society is not accepting the certificate. They are saying if you will cut the balcony window then we will complaint about the whole covered shade in balcony as it is unauthorised. Above our balcony there is nothing. 1) My question is is it really illegal to enclose or cover the complete balcony with shade? 2) I want to cut the balcony wall as there is no harm

It is not illegal to cover your balcony unless you have not paid the charges for the same however to make any structural changes in your flat including the balcony you will require the permission of the society as also the CIDCO
