AAdhar photos taken forcefully

18-Aug-2023 (In Civil Law)
Recently the guards of a gated area (a university) took photos of my AAdhaar and one person in civil dress who was clearly not a guard even abused me and atrociously beat me because they THOUGHT I was a thief because I mistakenly tried to get into the premises. Even though I did not enter it. nn1. Is it okay I had to let them take a photo of it? Can the fact that they have picture of my AAdhaar get me into legal trouble? nn2.If not, can I take a legal action against them for doing so?

Yes…you can and you should report this matter in writing to the nearest police station of your area and get it stamped from the police station. And if the fight was more grave then you should get the medical done. For more legal assistance I am just a call away.

You can get the complaint drafted in this regard via an advocate and submit it to the police station of the university. Subsequently in case anyone uses your Aadhaar card this complaint will act as a proof for the same ! Thanks

Hi, if you haven’t entered the premises the security guards would have no right to search or even look at your identification since they only have the power to deny admission into the premises they have been contracted upon. Thus, their act of beating you up and abusing you is an offence and them forcibly taking a photo of your aadhar card without your consent would be a breach of your privacy. You may consider filing a police complaint against them.
