Which Courts have jurisdiction to entertain complaints under Section 138 of the Negotiable Instruments Act? please explain with reference to landmark case/cases?

You can file the complaint in court where the complainants bank is situated or where accuse bank is situated. Any court where drawers or drawee's bank is situated at that place complainant can file complaint.

1. Metropolitan magistrate has the jurisdiction to entertain 138 matters;
2. This could also depend on the jurisdiction of the case, the bank, the place of residence of complainant;
3. Consult a local lawyer and take steps.

The Courts where you have your Bank account will have jurisdiction over the matter. It is important to understand that you may deposit the Cheque at any Branch but only the Home branch will determine the jurisdiction under N. I. Instrument Act.
