NIA 138 case in bailable warrant status for an unsecured loan
13-May-2025 (In Cheque Bounce Law)
I have an unsecured business loan.
I will have to appear before court to get the bail. I’m sick and genuinely out of money.
Is it possible to get bail without submitting surety and bond?
If so on what ground ?
Before any person is released on bail or released on his own bond, a bond for such sum of money as the police officer or Court, as the case may be, thinks sufficient shall be executed by such person, and, when he is released on bail, by one or more sufficient sureties conditioned that such person shall attend at the time and place mentioned in the bond, and shall continue so to attend until otherwise directed by the police officer or Court, as the case may be.
Prepare a formal motion requesting bail. Include your medical documentation and financial records to substantiate your claims.
- **Include Legal Grounds**: In your motion, refer to any relevant laws or precedents that support your request for bail without surety. For instance, some jurisdictions allow for personal recognizance (PR) bail in cases of financial hardship or health issues.
If you're sick, out of money, and facing arrest for an unsecured loan, bail without surety is possible under CrPC & Bharatiya Nagarik Suraksha Sanhita. Courts consider medical & financial hardship. As your advocate, I can file for bail on grounds of indigence and illness, seeking personal bond or no bond at all. Contact me for immediate legal help and strong representation.
