First issue a legal demand notice. If payment is not made within 15 days, file a complaint under Section 138 of the Negotiable Instruments Act seeking recovery of the cheque amount, interest and costs. Act promptly to avoid limitation. Feel free to contact me.

First of all rather than going legally you should serve him/her a legal notice and in that notice you can write that either pay my money or face legal action which will be at your own risk. After that if he/she fails to give you a satisfactory reply then you can anytime file a complaint under section 138 NI Act in the court to claim your money back along with compensations.

Firstly you are required to send a legal notice to the issuer of the cheque through an advocate before 20th July as there is a time period of 30 days to send legal notice after receiving the return memo from the bank. Even though after receiving legal notice he fails to pay the amount you can file a case under Section 138 of the Negotiable Instruments Act.

Yes you can file a case against the same person, firstly you have to send a legal to that person within 15 days, and after 15 -20 days of sending legal notice you can file a case against that person, so if the cheque was bounced on 20 june, you have limitation period of sending legal notice within 15 days i.e, 5 July and after that you can file case within 15-20 days of sending legal notice, i.e 20-25 july, hope so you understand what I am trying to say

Issue a legal notice within the prescribed time under the NI Act. If payment is not made, file a cheque bounce case under Section 138 and also seek recovery. Preserve the bounced cheques and bank return memos.
