How to proceed on Non CTS Cheque bounce.

Hi, I had lent money to one of my friend in 2013 and 2014. He had issued me an NON-CTS cheque which i was not aware of it at the time he issued without date. He was saying he will give money and he has pushed till date without returning my money.So i thought of bouncing the cheque and submitted to bank. The cheque came back saying Bank excluded from CTS. Can i file a case against him. Please let me know how i can proceed.

For every transaction limitation of 3 years applies, so you cannot proceed with both civil and criminal case and if you alter the transaction timeline then there is no bar for you to filing cheque dishonour case , you can filing upon same reason of endorsement but you have to narrate the facts carefully to proove the facts in the case.

You can also proceed by way of filing Civil Case i.e. Suit for Money Recovery along with interest and compensation. But, it is advisable to file only if you have proof of payment of debt amount. You can contact me for the purpose of filing the case.

1. you may file both criminal and civil complaints against him.

2. is the person accessible to you?. if yes you can collect fresh cheques.

3. any agreement is made out here?. also pls get back to me with transaction details.
