Can i settle my cheque bounce case outside the court

I got a notice from the court to appear regarding cheque bounce case. Is it good that I can settle the amount outside the court and they take their case back?

Yes , You can do it legally , there is no bar in doing it. It will be adviasble for you that you go to the court and ask for the compound ing of the case there only as it will help u in getting a compromise deed which will be signed in the presence of the mediator and the case will be witdrawan before the court in your presence. It will be better option for you , don't rely if you have already suffer a blow.

if you are willing to settle the matter for the principal amount/amount for which the cheque got dishonoured then, the court has the power to finish the matter even if the Complainant does not want to settle.
If you want to settle the matter then draft a Settlement Deed and file it before the court on the next date of hearing. Also, record your statement before the court.

Yes it would be totally legal to settle the case outside the court. And it is a normal practice to settle such kind of matters outside the court. What I would suggest is that when you are settling the case with the other side, the terms of settlement should be in writing and the same settlement agreement can be submitted in the court so that terms of settlement can be brought on record.

Once you have received a notice from the court , this means that now you are obliged to appear before the court, as this happens to be a criminal complaint under the negotiable instruments act, if you don't appear before the court, on the date court might issue a bailable or even a non-bailable warrant against you.

but there is a good news for you, since these days courts wish to wrap up the cases in the most expeditious manner, you can appear before the judge on the date and when the matter is called , you can just request the judge that you wish to settle the matter and to please send the matter fro mediation, that on the very same day you can wrap up the case.

or if you can come in contact with that person before the court date, then ask him to settle the matter, that way you both settle the matter before the court and on the date, you can go to the court and get your statements recorded that you have settled the matter and so the other person
(the complainant ) will be ending the case. this way you will be free of the court liability by all means.
