Questions Answered by Advocate Vaibhav Raina
Q: Clarification regarding patent and copyrights
We are manufacturing an electronic product for a client of ours. The client has a utility patent for the product (idea). But we have developed the product in flesh from its circuitry to its 3D modelling, schematics etc. The client has not contributed financially to the company in the product development whatsoever. Now since that we are moving from sampling to manufacturing stage we are drafting a new contract. In the contract we claim to have the rights to all the circuit and CAD designs since we developed them. We also acknowledge that the client is the sole owner of the idea and without his permission we cannot manufacture or sell the product. The client has only paid for the samples and we did not charge him anything for product development and are providing the solutions for free. But that doesn't mean he owns the copyrights. He wanted us to contact an attorney to shed some light on this topic.

Hi, The answer to this depends on whether the patent included the circuitry and other schematics, also, on the terms of the original contract. If the original contract stated that all IP pertaining to this would lie with the patent holder then it might be difficult for you to claim rights. Best, Vaibhav Raina
Q: How to claim grandfathers property after his death
Father is getting treatment from Institute of Human Behaviour and Allied Sciences for mental disorder. Grandfather has been expired. How to get property in my name registered
Advocate Vaibhav Raina answered
Hi,Can you please tell me in whose name is the property registered as on date? Did your Grandfather leave a will? Do you and your father have any siblings? And the property you are referring to, is it self acquired of your Grandfather or ancestral property? Looking forward to hearing from you.Best regards,Vaibhav RainaAdvocate
Q: Rape charges on man by girl who had consensual sex with him
If a person some time/months/years back had consensual sex with a woman and continued to do so for some time . And later that woman files a complaint with the police that she was being raped by the man. Then will that man be arrested and put behind bars under section 376 just on the basis of woman's allegations/testimony? And will there be no medical test or investigation done before convicting the person on the charges of Rape?
Advocate Vaibhav Raina answered
Dear Client, Thank you for writing in.Your question can be divided into two parts. One, arrest on the complaint of a woman and two, conviction for commiting a rape.S. 376 is a cognizable offence which means that the police can arrest the accused simply on the basis of a complaint. The second part of your question is regarding conviction and prior to convicting an accused, all evidence including medical tests etc. are considered by the Court. However, in the situation that you have described, it is very unlikely that medical tests etc. will be conducted nor are they necessary. The evidence required to prove innocence and a consensual relationship could be phone records, text messages, emails etc.I hope the above is of help. Best regards, Vaibhav Raina Advocate
