Q: Boy's parents threatening suicide if he continues marriage with me

From last 5years I love a boy and he too loves me. We want to get married but his parents are not ready. My parents are ready for the marriage. We have tried a lot to convince them. So we decided to go ahead with Court Marriage, Pune without consent of his parents. My family members are very supportive for our decision marriage except my father but after so convincing and time given to boy to convince his family for marriage but his parents didn't accept, after so much discussion he agreed. We got married on 23rd December 2016 without consent of his parents.. As boy convinced my family by booking new flat and assuring that he will leave his parents after court marriage if they didn't accept us. But situation is his parents giving suicide note threatening or they will end there life if you leave home and they are not going to accept our marriage. His family didn't shared anyone about our marriage except his cousin and he is not supportive.

You are already married so there's no going backwards. Let some time pass, and have patience. Try to convince and be humble as far as possible with the boys parents. Don't worry they won't commit suicide.

Q: Laptop confiscated by police,hard disk removed and send for cloning

Section 67A of IT Act,2000 applied: Laptop(not in a working condition) was confesticated by police. After almost 1.5yrs Police contacts and asks to take away the laptop but said that they have removed the hard disk and have sent to forensic so as to get the data extracted for the purpose of filing the chargesheet. (Note: Chargesheet is not yet filed) 1. Does this affect to the integrity of the evidence? 2. Shall I take the laptop without Hard disk or not? 3. Is it legitimate on part of the police to hand over the items listed in Panchnama without courts order as no notice for recovery has been furnished from my side? 4. Police asks to pay for the new hard disk purchased by them for cloning the original one. Who is bound to pay that amount? (Note: Original Hard disk was corrupt.) Thanking in advance

I think that it won't affect the credibility of the evidence. Though they will file it their way, the court always believes that data can be retrieved. If its corrupt one's a lucky man. They may or may not give you an acknowledgement of receiving hard disk in so and so crime. It will be returned to you after some months. The State Government bears the cost. The police purchase the storage devices and they later on produce those bills and get it refunded.

Q: Can hard disk of laptop be sent for cloning without court's permission

Hi Just wanted to enquire if the confesticated stuffs like hard disk og a laptop which is corrupt can be send by cops for cloning without the permision of the court , Also the laptop of which hard disk was send be handed over to the person without an aknowledgement of the court

Recently a law is passed by Supreme Court that the police needs to produce a seizure warrant for confiscating any person's mobile. The law relating to proper seizure of electronics like laptops and other such memory storage devices, already existed. Depends upon the type of crime and where it is being tried. If the matter is for just an investigation then police can seize devices with the permission of their seniors. Whereas if it is a judicial matter and or is a question of protecting personal data, the court may order for seizure or not to seize that device. Indian citizens lacks awareness and the police lacks knowledge of procedure in cyber laws.

Q: False case filed by my wife's father against me, how to prove it

First of all you must file an anticipatory bail as the police may arrest you anytime. Next step is after getting bail you must make a complaint before the magistrate regarding false FIR. BY DOING THESE THINGS YOU WILL BE FAR FROM THE CLUTCHES OF DOMESTIC VIOLENCE CASE IN THE FUTURE.

Q: Clarification on credit card fraud transaction

Some one done 37 thousand rupees of fraud transaction using my citi bank credit. I immediately blocked the card & ask them to dispute the transaction. But now this Citi Bank people says that, the transaction is done by using IPIN, so they can't put this in dispute. I already lodge a complaint in Local police also. This bank people already sent me a bill including that amount. What to do now ?

Lodge a complaint with your city's cyber crime division or write a letter to the DCP. The FIR that you have already lodged should also be supplied to them. They can help trace the IP address from where the IPIN was used. Secondly, regarding the bill, you can try to personally convince the bank officials by showing them the FIR. May be they can give you some time or they will not levy extra charges for late payment. YOU MUST SECURE YOUR IPIN IN FUTURE.
