Q: No Interim Maintenance Yet -DV Case filed in 2015

I have filed for a DV case on grounds of physical, mental and financial torture in July 2015 and yet to get the interim maintenance for my child . My husband had agreed to pay a some of 10k per month in 2016 which he paid only for a period of 8 months . Post which he stopped stating that he would only pay once the court asks him to . I have only asked for maintenance of our daughter as I earn only 30k a month and it is not possible for me to manage all the expenses . My husband is a real estate broker hence I don't have any income proof but he earns around 1 lakh a month. He has been in an extra marital affair since 2011 and i also submitted proofs for the same . What should I do to atleast start getting the interim maintenance . I have been requesting the honourable court to pass the order for the same but have been getting only dates since 10 months now after all the arguments have been concluded .

ask the judge to decide your interim application of maintenance immediately and keep aside the rest of the case till the decision of this application. vans I will decide your application of maintenance decide everything of the case then you will start getting the from your husband and If he's not ready to pay you then file an execution case

Q: Mutual divorce advise for second motion

Before second motion husband is asking to trasfer the property on his name / give power of attorney in leiu of money. 9 years we are seaparate and he has still not given divorce for the dispute of this property. What is confirmation he will come for the second motion, how this can be done???

first of all you check the things that whether you are compromising the matter with the return of this property or without return of this property. As well as the amount you are going to get in compromise. rest the fact of your case are not so clear . proper reply is little bit difficult for your case right now.

you can withdraw the case after moving an application in the court and after getting permission from court. No problem at all. Any body who has filed the case , can withdraw it . So accordingly just move an application with the proper court of jurisdiction and get the permission of withdrawal and withdraw it.

Q: 506 IPS and continuous harrassment

I live where there are only around 50 residents. Thes president of RWA filed 506 IPC against me based on a email exchange and lodged FIR in 506IPC. I got bail in court.RWA oppossed President as he did without approval of anyone and took his vengeance on me. Secretary is not taking action against presiden as he has disobeyed the GBM resolution by not taking the complaint back in court by submitting a affidavit, but instead appointed a counsel and opposed the bail. I have got married in kolkata but in both of us are in gurgaon right now. Can we get a divorce from here?

yes, You both can file the divorce case at Gurgaon in the court of District and Sessions judge at Gurgaon. As you both are residing at Gurgaon then there is no problem in filing the case at the Gurgaon court for you.
