If the government proposes to acquire the site, then a notification under the Land Acquisition Act has to be published in the gazette. The date of publication is usually taken to fix the market value of the land. Ordinarily enquiries are made about the prevailing prices near about the site, which is called the data land. Such a data land must be equal to the acquired land in the sense it is similar in all aspects such as location, size and related factors. If the officer fixes the market value to the dissatisfaction of the owner, he should give his objections is writing and demand his own compensation. Thereafter the matter will be referred to the civil court having jurisdiction over the area for fixing the compensation under the Land Acquisition Act. The owner must keep track of these steps diligently. Very often these steps stagnate in the respective offices. Therefore the owner must be vigilant in tracking and chasing the same.
