Delhi High court calls Hauz Khas Village "A Ticking Bomb"

The Delhi High court while hearing a batch of petitions held that the posh party place of Delhi has outrightly flouted laws and safety measures and unfortunately the civic authorities have turned a blind eye to all this. The Delhi High Court in its order held the place as “ ticking bomb” .

The bench headed by Chief Justice Gita Mittal observed that it is unfortunate how the civic agencies have turned a blind eye to all this and how the South Delhi Municipal Corporation and Delhi Police have allowed the commercialization when the same is leading to public nuisance and public hazard.

It is extremely shocking that how the licenses are allowed to these restaurants, pubs, and bars without checking the ground realities. Further, the sewage system was not at all robust to take the load from the bathroom and kitchens of these restaurants and pubs.

These petitions claimed that the restaurants, pubs, bars, and cafes were running illegally as they do not have requisite permission and by violating the provisions of Delhi Municipal Corporation, Act 1957 and building bye laws, the master plan of Delhi, 2021, the Delhi Fire Safety Act, 2007, the Delhi police Act, 1978.

The petitioners have also accused these places of violating the licensing of commercial activity, impacting public safety and environment and also the fundamental rights enshrined under Article 21 of Constitution of India.

The bench observed, “ It appears from the material place that no comprehensive solid waste management and sewage disposal evaluation has even entered the minds of the concerned experts or the municipal authorities while permitting such activities or granting license.& quot
