Will having an FIR affect my future prospective of government job

07-Feb-2023 (In Labour & Service Law)
I am preparing for govt. jobs of SSC level. 5 years ago we had a family dispute with our neighbors and my name was also put in FIR. I was not arrested though and got an anticipatory bail. After several hearings case ended in a compromise. Will it affect my job in future or can I do anything in court so that I will not have a problem in future.

It is the cardinal rule of Indian criminal jurisprudence that an individual is held to be innocent until charges against him are proven. This rules gives the right to any person against whom charges are pending to apply for government job, and no discrimination can be made against him for selection just because trial is pending and until he is convicted.

However in your case charges were proven to be false and acquittal was done, that leaves no room for barring of selection on grounds of criminal proceedings. But you must ensure one thing, that you must should disclose the full facts in your application forms at the time of applying the job. Concealing the facts related to FIRs or criminal proceedings may amount to misconduct and may prove to have an adverse effect on your selection.

If the case was compromised then it will depend upon what was last written in the order. If the case was decided in your favor then you have to mention about the case in all your government job application. If the case was dismissed on the ground of compromise then again you have to mention about this case in all the government applications. But in case the registered FIR was quashed based on the compromise then you don't have to mention about this case at any place.
