Injustice in PSU exam result. What can I do?

27-Jan-2023 (In Labour & Service Law)
Injustice has been done to me in an PSU exam result, I have not been shortlisted despite I have all the documents submitted and fullfilled the term and condition of the advertisement. Offer letter has been issued. If I file a case now in High Court, Can I get a stay on the recruitment/joining process??

This depends on the comparative assessment of the competing candidates. If some other candidate also fulfills the terms and conditions, then there will perhaps be some comparative assessment between you and the other candidate in terms of the Recruitment Rules/Executive Guidelines/Advertisement Clauses. A complete answer can be given only after going through all the above-mentioned criteria. If the competing candidates is below your merit after a collective assessment, then he cannot be selected and then there definitely can be a case with good merit against the selection process.

Fulfilling the terms and conditions of advertisement does not create any vested right for selection to the next round and unless you can prove large scale irregularities in the selection process itself, such as large scale cheating, answer script tampering etc., then the selection process does not get vitiated. As such, the question of interim order on such a large selection process also is not favourably considered by the High Court unless clear instances of bias, manipulation, nepotism etc, are shown by the petitioner
